Terms and Conditions of the bromantan.pl Online Store

These Terms and Conditions set out the rules for using the online store available at bromantan.pl, the conditions for placing orders for the chemical reagents offered, the principles for concluding and performing sales contracts, as well as the rights and obligations of the Customer and the Seller. These Terms and Conditions constitute a standard contract template within the meaning of Article 384 of the Polish Civil Code and are made available free of charge in a form that allows them to be obtained, reproduced and stored.

NOTICE: All products offered in the bromantan.pl store are chemical reagents (chemical substances with a purity of ≥99%) intended EXCLUSIVELY for laboratory, research, analytical and scientific purposes. The products ARE NOT INTENDED FOR HUMAN OR ANIMAL CONSUMPTION, are not medicinal products, dietary supplements, cosmetics, food or medical devices, and must not be used as such.

§ 1. General provisions and definitions

The terms used in these Terms and Conditions have the following meanings:

  • Seller — the entity operating a Polish chemical laboratory and the bromantan.pl online store, engaged in the synthesis and production of chemical substances for the needs of universities, scientific and research institutions, and commercial entities; all products offered are manufactured in Poland (Made in Poland).
  • Customer — a natural person with full legal capacity, a legal person, or an organisational unit without legal personality to which the law grants legal capacity, who places or intends to place an Order in the Store.
  • Consumer — a Customer who is a natural person performing a legal act with the Seller that is not directly related to their business or professional activity, within the meaning of Article 221 of the Polish Civil Code.
  • Store — the online store operated by the Seller at bromantan.pl together with all its subpages.
  • Goods / Reagent — a chemical substance with a chemical purity of no less than 99% (≥99%), presented in the Store as the subject of an Order, intended exclusively for laboratory, research and scientific applications.
  • Order — the Customer's declaration of intent aimed directly at concluding a distance sales contract for the Goods via the Store, specifying the type and quantity of Goods and the remaining terms of the contract.
  • SDS / MSDS — the Safety Data Sheet for a chemical substance, prepared in accordance with the REACH Regulation and applicable regulations.

The provision of electronic services within the Store is carried out in accordance with the Polish Act of 18 July 2002 on the provision of services by electronic means. To use the Store, a device with Internet access, a current web browser and an active e-mail account are required.

§ 2. Seller's details and contact

The Seller and administrator of the Store is a Polish chemical laboratory operating under the bromantan.pl brand. The Seller may be contacted on all matters relating to the operation of the Store, the placing and processing of Orders, complaints and the provision of safety data sheets by electronic mail:

The Seller endeavours to handle electronic correspondence within a reasonable time, usually within business days. The Seller's detailed registration data is made available at the Customer's request and to the extent required by law.

§ 3. Nature of the products offered

All Goods offered in the Store are chemical reagents of very high chemical purity of at least 99% (≥99%). These are substances that require careful handling and specialist knowledge regarding their safe use, storage and disposal.

The reagents may be used exclusively for laboratory, analytical, research and scientific purposes. The products offered in the Store ARE NOT FOR CONSUMPTION. Only an adult who is aware of the nature of the substances purchased and who has the conditions for their safe and lawful use may make a purchase.

By placing an Order, the Customer declares that they are purchasing the Goods for purposes consistent with their intended use, i.e. for laboratory, research or scientific applications, and that they possess the necessary knowledge and infrastructure to safely handle chemical substances. When working with the reagents, the Customer is obliged to use appropriate personal protective equipment (occupational health and safety measures), in particular:

  • disposable protective gloves resistant to chemical substances,
  • a laboratory coat and protective glasses or goggles,
  • a protective mask or respirator with an appropriate filter, where required by the nature of the substance or the activities performed,
  • working in a ventilated room or under a laboratory fume hood, in accordance with the recommendations of the safety data sheet.

Each item of Goods is labelled in accordance with the Polish Act of 25 February 2011 on chemical substances and their mixtures (text of the Act) and in accordance with Regulation (EC) No 1907/2006 of the European Parliament and of the Council (REACH) and Regulation (EC) No 1272/2008 (CLP) regarding the classification, labelling and packaging of chemical substances. The safety data sheet (SDS / MSDS) for each item of Goods is provided free of charge at the Customer's request — to obtain it, please contact us at sklep@bromantan.pl.

§ 4. Placing orders and concluding the contract

Information about the Goods presented in the Store, including their descriptions and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code, and not an offer within the meaning of civil law provisions. Orders may be placed around the clock, seven days a week, using the functionality of the Store.

The process of placing an Order comprises the following steps:

  • selecting the Goods and their quantity and adding them to the cart,
  • providing the data necessary to process the Order and selecting the delivery and payment method,
  • reviewing and accepting these Terms and Conditions,
  • confirming the Order by clicking the button marked as entailing an obligation to pay.

The placing of an Order by the Customer constitutes an offer to conclude a sales contract for the Goods. The sales contract is concluded upon the Seller's confirmation of acceptance of the Order for processing, sent to the e-mail address indicated by the Customer. The Seller reserves the right to verify the Order and to refuse to process it in justified cases, in particular where there is a suspicion that the Goods would be used contrary to their intended purpose or in breach of applicable law.

§ 5. Prices and payments

The prices of the Goods presented in the Store are given in Polish zlotys (PLN) and include all applicable taxes, unless otherwise stated in the description of the Goods. Prices do not include delivery costs, which are presented separately during the Order process and on the Shipping page.

Detailed information about the available payment methods can be found on the separate Payments page. The Seller offers, in particular, the following forms of payment:

  • a traditional bank transfer to the Seller's account,
  • payment in cryptocurrencies — recommended and preferred for larger Orders, under the terms described on the Payments page.

Processing of the Order begins once the payment has been credited to the Seller's account, unless otherwise agreed for the selected payment method. Failure to pay within the period indicated in the Order summary may result in cancellation of the Order.

§ 6. Fulfilment and shipping

The Goods are packaged in a manner appropriate to the nature of chemical substances, ensuring their integrity and safety during transport, in accordance with the applicable regulations on the transport and packaging of chemical substances. The Order fulfilment period is counted from the moment the payment is credited and includes the time required to prepare the Goods for shipment and the delivery time by the carrier. The Seller exercises due diligence to ensure that Orders are processed on time; however, the Seller is not liable for delays resulting from circumstances beyond the Seller's control, including those attributable to the carrier or to force majeure.

§ 7. Quality and control

The Seller maintains rigorous quality control of the reagents offered. Each batch of Goods undergoes analytical testing to confirm the declared chemical purity of at least 99%. The control methods applied include, in particular:

  • spectrographic (spectroscopic) analysis confirming the identity and structure of the substance,
  • chromatographic analysis to determine the degree of purity and to detect any impurities,
  • determination of heavy metal content expressed in PPM (parts per million),
  • a synthesis process carried out in accordance with the requirements of an environmental management system based on the ISO 14001 standard.

Analytical documentation confirming the quality of the Goods, including the safety data sheet (SDS), is provided to the Customer on request. The Seller strives to ensure the consistent and high quality of all reagents offered.

§ 8. Complaints and returns

The Seller is liable to the Customer under warranty for defects in the Goods on the terms set out in the Polish Civil Code and — in the case of Consumers — on the terms arising from the Act of 30 May 2014 on Consumer Rights. The Seller accepts complaints concerning the quality of the Goods, their non-delivery and damage in transit.

Complaints should be submitted electronically to sklep@bromantan.pl, indicating the Order details, a description of the identified defect or irregularity, and the Customer's request. The following rules apply to complaints concerning the chemical quality of the Goods:

  • a complaint concerning quality should be supported by laboratory test results, i.e. a spectrogram and a chromatogram, performed by an accredited or reputable Polish laboratory,
  • a refund of the price of the Goods is made where it is confirmed that the Goods do not meet the declared quality criteria, after the Goods have been returned to the Seller,
  • if a quality complaint is upheld, the Seller reimburses the Customer for the documented cost of the physicochemical tests performed in Poland, based on the average market prices applicable to such analyses.

Complaints concerning non-delivery or damage in transit should be reported immediately upon discovery of the irregularity; it is recommended to draw up a damage report in the presence of the carrier. The Seller examines complaints without undue delay and, in the case of Consumers, within 14 days of receiving a complete complaint, informing the Customer of the manner of its resolution.

§ 9. Right to withdraw from the contract

A Customer who is a Consumer, as well as a natural person concluding a contract directly related to their business activity where the terms of that contract indicate that it does not have a professional character for that person, has the right to withdraw from a distance contract, without giving any reason, within 14 days, in accordance with the Act of 30 May 2014 on Consumer Rights. The time limit begins on the day on which the Customer or a third party indicated by the Customer takes possession of the Goods.

To exercise the right of withdrawal, the Customer must inform the Seller of their decision by means of an unequivocal statement sent to sklep@bromantan.pl before the withdrawal period expires. In the event of effective withdrawal from the contract, the Seller reimburses the payments received, including the costs of delivering the Goods, on the terms set out in the Act.

The right of withdrawal does not apply to contracts in which the subject of the performance is Goods manufactured or prepared according to the Consumer's specification or serving to satisfy their individualised needs, nor to Goods which, after delivery, due to their nature as a chemical substance, are inseparably combined with other items, or the packaging of which has been opened and which, once opened, cannot be returned for reasons of hygiene, safety or health protection (Article 38 of the Act on Consumer Rights).

Due to the nature of the chemical reagents offered and safety requirements, the Goods are sold in sealed, secured packaging. Opening the packaging of a reagent may exclude the possibility of its return under the right of withdrawal, to the extent permitted by the provisions referred to above.

§ 10. Liability

The Seller is liable for the conformity of the Goods with the contract to the extent arising from mandatory provisions of law. At the same time, to the fullest extent permitted by law, the Seller is not liable for the consequences of using the Goods in a manner inconsistent with their intended purpose, i.e. other than laboratory, research or scientific.

The Seller is not liable for any damage resulting from the consumption of the Goods, their use on humans or animals, use inconsistent with the safety data sheet or applicable regulations, or from the improper storage, mixing or disposal of the reagents by the Customer. The Customer bears full responsibility for the manner in which the purchased Goods are used.

The limitations of liability referred to above do not exclude or limit the Seller's liability to the extent that this is impermissible under mandatory provisions of law, in particular towards Consumers.

§ 11. Protection of personal data

The controller of the Customers' personal data is the Seller. Personal data is processed for the purpose of fulfilling Orders, performing the sales contract, handling complaints and fulfilling the legal obligations incumbent on the Seller, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and applicable national law.

Detailed information on the scope, purposes and legal bases for processing personal data, the retention period and the rights available to the Customer (including the right to access, rectify, erase, restrict processing, port the data and object) is contained in the Privacy Policy, which forms an integral supplement to these Terms and Conditions.

§ 12. Final provisions

In matters not regulated by these Terms and Conditions, the provisions of Polish law apply, in particular the Act of 23 April 1964 — the Civil Code, the Act of 30 May 2014 on Consumer Rights, the Act of 18 July 2002 on the provision of services by electronic means, and the Act of 25 February 2011 on chemical substances and their mixtures, as well as the relevant provisions of European Union law, including the REACH and CLP Regulations and the GDPR.

The Seller reserves the right to make changes to these Terms and Conditions for important reasons, in particular in connection with a change in the law or the scope of services provided. Orders placed before the changes take effect are governed by the provisions of the Terms and Conditions in force at the time the Order was placed. Any disputes arising from contracts concluded via the Store will be resolved by the competent common courts; in the case of disputes involving Consumers, the jurisdiction of the court is determined by generally applicable law. A Consumer may make use of out-of-court methods of handling complaints and pursuing claims, including the online dispute resolution (ODR) platform operated by the European Commission.

These Terms and Conditions are effective from the date of their publication in the Store and are available free of charge at bromantan.pl in a form that allows them to be downloaded, stored and printed.
